Conveyancing – Part 2

We’ve talked about several preliminary steps of conveyancing required when you purchase a property. These steps are designed to protect your interests; when done properly, you can avoid the risks of buying a bad property or dealing with future legal problems. Once the preliminary steps are completed, you can continue with the next steps of conveyancing.

It is essentially important for your solicitor to make sure all your interests are protected. He will apply to local council for local searches, checks the title, contract and papers, and raises queries with the seller or seller’s solicitor regarding possible issues. For example, it is your solicitor’s duty to check whether the seller really owns the property and has the right to sell it.

Once all checks are completed, both parties can start negotiating a contract. The contract must be agreed by both parties and a completion date must be set. Normally, the solicitor will arrange for the completion date to be set in two weeks after the contract is agreed, although the time can be shorter or longer.

If you are financing the purchase using a mortgage loan, now is the time to get a formal mortgage offer. by signing the mortgage offer, you are agreeing on the terms offered by your lender and the mortgage will be approved right away.

Even after all these steps, there are still more steps to take before you own the property legally. However, your solicitor will do all the hard work for you once the necessary papers are in order.

Moving Down The Street

If you move across the country or down the street no one looks forward to this task. Some of us get tired thinking about it. Moving can be made smooth by being one step ahead and having everything to pack ready for the day you start until you return the rental truck. Timing important the longer you have the truck the more money it will cost you. You can start two weeks in advance by separating everything room to room. Have all your supplies and professional movers blankets ready as well. Many of the supplies you need you can find at the local dollar store for half the price. Check around at the local lumber yard stores in your area for moving blankets or better yet see if you have any at home not being used.

They can be washed and used again. Pack as much as you can several days before and secure the boxes well with tape. Spills are not a good thing in the middle of a move. Focus on glass and double wrap with blankets or put between card board and tape with boxes and wrap with blankets. Slide them upright between to pieces of furniture inside the truck. Do not feel confident when you are only moving a block or two away, because if you have to hit the brakes you could with stand some serious damages. Make sure the furniture and heavy boxes are all up front of the truck so there will be no chance of sliding from inside the truck. A short move will go quite easy if you make sure everything is stable as if you were going across the country. With that in mind take your time and the move will go as planned. And everyone will feel better after the move is complete.

After agreeing on a certain price for the property you plan on buying, there are several legal steps you need to take in order to legally own the property. These steps are summed up as conveyancing, and we are going to discuss the first few steps of it right here in this article.

After hiring a solicitor, you can have your solicitor contact the seller’s solicitor to discuss the necessary details and create a draft contract that suits all agreed terms. Your solicitor will negotiate draft contract on your behalf until proper agreement is reached.

Several pre-contract inquiries are necessary, especially since these inquiries can help you stay on the safe side at all times. You don’t have to worry about potential future problems once the necessary inquiries are completed since all details regarding the property will be reviewed closely.

Once these steps are completed, your solicitor will then send you the complete bundle of information along with the draft contract for you to review. Be sure to review them quickly but make sure you understand each point properly before moving forward with the purchase. You will also receive fixtures, fittings and contents form listing items that will be removed from the property by the seller once the sale is completed.
